$2k for no seat belt; $30k for speeding – big fines under Traffic Act

The House of Representatives on Tuesday passed the new Road Traffic Act which signalled a major overall of the 80-year old Act which came into being in 1938 and which it effectively repealed.

Transport Minister Mike Henry and the Road Safety Unit in the Ministry of Transport are of the view that the new act, with its much steeper fines for traffic breaches, will go a far way in reducing the carnage on the roads which sees upwards of 300 people being killed each year.

Even persons who ride bicycles will now be required to wear a safety helmet or pay a fine!

There may be more amendments when the new Act goes to the Senate on Friday for approval before being sent to the Governor General for his signature and passage into law.

Of note is that the Island Traffic Authority will be given broad and far-reaching powers under the new Road Traffic Act, up to, and including the granting and revocation of driver’s licences.

Loop News has listed below, some of the major breaches and the accompanying fines. Of note is that motorists can now be imprisoned for many offences where previously only a monetary fine was applicable.

*Driving or causing motor vehicle to be driven on the road without valid certification of fitness – $4,000

*Driving or causing motor vehicle to be driven on road without it being registered in the prescribed manner – $10,000

*Driving or causing motor vehicle to be driven on road without it being licensed in the prescribed manner – $10,000

*Driving or causing motor vehicle to be driven on road without motor vehicle insurance coverage -$20,000

*Driving motor vehicle without evidence of insurance, valid certificate of fitness or motor vehicle licence or failing to surrender evidence of insurance, valid certificate of fitness or motor vehicle licence – $5,000

*Using registration plates or licence decal issued in respect of a motor vehicle for any other motor vehicle -$10,000

Failure to operate motor vehicle in compliance with the prescribed requirements and conditions – $10,000

*Using a motor vehicle in contravention of the terms of the licence -$10,000

*Employing or permitting another person to drive a motor vehicle on a road, without the person being the holder of a driver’s licence entitling the person to drive that motor vehicle – $15,000

*Failure to operate motor vehicle in compliance with prescribed requirement and conditions – $20,000 and on default of payment to 15 days imprisonment

*Using a motor vehicle in contravention of the terms of the licence – $30,000 or 15 days imprisonment

*Using motor vehicle with the registration plates or licence decal affixed in such a manner so as to render them obscured or not easily distinguishable $10,000 or 15 days imprisonment

*Using motor vehicle with the registration plates or licence decal obscured in such a manner that the characters cannot be read – $10,000 or 15 days in prison

*Using motor vehicle which is not licensed in accordance with the Act – $30,000 or 30 days

*Employing or permitting another person to drive a motor vehicle on a road, without the person being the holder of a driver’s licence entitling the person to drive that motor vehicle, or as the case may be, a motor vehicle of that category – $15,000 or 15 days in prison

*Failure to produce permit or driver’s licence for examination by the constable in accordance with the Act – $10,000

*Driving motor vehicle without driver’s licence or learner’s permit in possession – $40,000 and disqualification for one year and in default of payment to 15 days imprisonment

*Driving motor vehicle without being the holder of a learner’s permit or driver’s licence -$10,000 or 15 days imprisonment

*Employing or permitting a person to drive motor vehicle without appropriate driver’s licence – $40,000 or 30 days imprisonment

*Applying for, or holding permit or driver’s licence where applicant holds another permit or driver’s licence of the same class – $50,000 or 30 days imprisonment

*Providing false or misleading information to Authority on application – $50,000 or 30 days

*Failing to comply with the terms and conditions of learner’s permit – $15,000 or 15 days

*Failing to comply with the breath alcohol concentration limit – $30,000 or 30 days imprisonment

*Failing to comply with the terms and conditions of driver’s licence during first year of issue $15,000 or 15 days imprisonment

*Refusal to surrender permit or driver’s licence when Authority declines to renew it – $20,000 or 30 days imprisonment

*Failure to submit permit or driver’s licence for suspension upon notification by Authority – $20,000 or 30 days imprisonment

*A person who is disqualified from holding or obtaining a driver’s licence – wilfully applies for, or obtains a driver’s licence while he is disqualified – $30,000 or 30 days imprisonment

OTHER BREACHES AND FINES ARE LISTED BELOW:

*Driver of motor vehicle failing to obey— (a) red lights or stop signs- $24,000 or 30 days (b) other traffic signs and lights – $16,000 or 15 days imprisonment

*Careless driving- where no collision occurs $11,000; careless driving- where collision occurs – $25,000

*Carry more than one person in addition to the driver on motor cycle -$5,000

*Carrying any person not seated astride motor cycle and on a proper seat securely fixed on motor cycle behind driver’s seat -$5,000

*Causing two-wheeled motor cycle to be driven on one wheel only – $5,000

*Drawing more than the prescribed number of trailers – $12,000

*Driving or operating motor vehicle without there being attached to the motor vehicle and in correct working order the prescribed— (a) headlamps – $5,000.00 (b) parking lamps $5,000.00 (c) reflectors $5,000.00 (d) rear registration plate lights $5,000 (e) brake lights $5,000.00 (f) warning devices $5,000.00 (g) seat belts $5,000

*Driving vehicle without wearing seat belt or person who rides in motor vehicle failing to wear seat belts – $2,000

*Driver of vehicle not causing passenger riding in motor vehicle to wear a seat belt -$2,000

* Driver of vehicle not causing a child to wear or be conveyed in a child restraint system -$5,000

*Driver of motor cycle or bicycle failing to wear prescribed protective helmet -$2,000

*Driver of motor cycle not causing pillion rider to wear prescribed protective helmet – $5,000

*Driver of vehicle sounding horn or warning device or causing loud noise to emanate from motor vehicle which cause annoyance to persons within silent zones -$5,000

*Exceeding speed limit within school safety zone (a) by 16 to 32km/h – $12,000.00 (b) by 33 to 49 km/h – $20,000.00 (c) by 50km/h or more $30,000.00

*Failure to comply with traffic signs – $10,000

*Failure to comply with traffic signs in construction zone – $10,000

*Exceeding speed limit within construction zone – $10,000
